These Website Terms of Use apply to your access to and use of www.vodori.com and any other Vodori website, webpage, landing page, blog, resource page, form, or publicly available online content that links to these Website Terms of Use (collectively, the “Website”).
These Website Terms of Use do not apply to your use of Vodori’s authenticated software-as-a-service application. Use of Vodori’s software-as-a-service application is governed by Vodori’s separate Product Terms of Use and the applicable Subscription Order Form or other written agreement (collectively referred to as “Subscription Agreement”) executed between Vodori and the subscriber that authorized access to the application.
By accessing or using the Website, you (“you” or “your”) agree to follow and be bound by these Website Terms of Use. If you do not agree to these Website Terms of Use, you should not use the Website.
1. Use of the Website
The Website is provided for informational, marketing, educational, and business communication purposes. You may use the Website only for lawful purposes and in accordance with these Website Terms of Use.
Use of the Website does not create any employment, customer, partnership, agency, professional, fiduciary, or other relationship between you and Vodori.
Vodori may revise these Website Terms of Use from time to time. The revised Website Terms of Use will be effective when posted on the Website, unless a later effective date is stated.

You represent and warrant that any information you submit through the Website is accurate, complete, and submitted by you lawfully. You agree not to submit information that you do not have the right to provide, including confidential, sensitive, proprietary, or personal information of another person or entity without appropriate authorization.
Information submitted through the Website is not “Subscriber Data” under Vodori’s Product Terms of Use unless it is separately submitted through Vodori’s authenticated software-as-a-service application under a Subscription Agreement.
4. Website Tracking and Analytics
By using the Website, you understand and agree that we may use cookies, pixels, analytics tools, session replay tools, embedded media, marketing automation tools, and similar technologies to operate, secure, measure, analyze, and improve the Website and Vodori’s marketing activities.
You further agree and understand that Vodori may use service providers to host, administer, operate, secure, support, update, analyze, and otherwise manage the Website. Vodori may collect and transfer information related to your visit to and use of the Website to such service providers, including, as applicable, navigation data, search string data, page interaction data, device and browser data, referral information, and video viewing or video interaction data.
Vodori’s collection, use, and disclosure of personal information through the Website is described in Vodori’s Privacy Policy and any applicable cookie notice, consent banner, or preference center made available through the Website.
5. Communications Consent
By providing your telephone number to Vodori through the Website or otherwise in connection with Website-based inquiries, demo requests, event registrations, resource downloads, or similar interactions, you are providing written consent to receive communications from Vodori (including its affiliates, agents, service providers, and affiliates for the purposes of defined above) for any purpose, including but not limited to marketing various services from both Vodori and companies Vodori has joint marketing agreements with. Additionally, you agree to receive communications from Vodori regarding your any service, and any information you may have obtained via your use of a Website. You agree that these communications include, but are not limited to, the use of an Automated Telephone Dialing System, prerecorded and/or artificial voice, SMS, MMS, text, fax, email or other similar means. Note, regardless of whether your phone number is registered on a state or federal Do Not Call list. You agree that Vodori is not responsible for any charges to you regarding these communications. Standard voice and data rates may apply. Should you wish to no longer receive communications, you may text “STOP” to cease receiving such communications. Further, you understand that you do not need to provide this consent to call as a condition to receive any good or service, in which case you will not provide your phone number.

Vodori’s Privacy Policy describes how Vodori collects, uses, discloses, and protects personal information. By using the Website, you acknowledge that Vodori may process personal information as described in the Privacy Policy and any applicable Website notices.

- violates or promotes the violation of any applicable law or regulation;
- infringes or misappropriates the rights of Vodori or any third party, including intellectual property, privacy, publicity, confidentiality, or proprietary rights;
- is defamatory, derogatory, threatening, harassing, abusive, obscene, or otherwise objectionable;
- promotes bigotry, racism, hatred, discrimination, or harm against any group or individual;
- contains viruses, malware, Trojan horses, or other harmful code;

To the maximum extent permitted by applicable law, Vodori disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
Vodori does not warrant that the Website will be secure, uninterrupted, error-free, free of harmful components, or available at any particular time or location.

- your violation of these Website Terms of Use; or
- your violation or infringement of any third-party rights.
13. Applicable Law and Venue
All matters relating to Your access to, and use of, the Website will be governed by U.S. federal law or the laws of the State of Illinois, USA. Any legal action or proceeding relating to your access to or use of the Website shall be instituted in a state or federal court located in Chicago, Illinois. You and Vodori agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
14. Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND GOVERNS HOW YOU AND VODORI CAN BRING CLAIMS AGAINST EACH OTHER. THIS SECTION WILL, WITH LIMITED EXCEPTIONS, REQUIRE YOU AND VODORI TO SUBMIT CLAIMS AGAINST EACH OTHER TO BINDING AND FINAL ARBITRATION ON AN INDIVIDUAL BASIS. THIS MEANS THAT YOU WILL NOT BE ABLE TO BRING A CLASS, COLLECTIVE, OR REPRESENTATIVE LAWSUIT IN A COURT OF LAW BEFORE A JUDGE OR JURY CONCERNING ANY DISPUTE COVERED BY THIS ARBITRATION AGREEMENT.
You and Vodori mutually agree to use binding arbitration for disputes that arise between you and Vodori, its related and affiliated companies, and any current or former employee, officer, director, contractor, or agent of Vodori or any related or affiliated company, as such disputes relate to your use of the Website or these Website Terms of Use.
You and Vodori agree that this Arbitration and Class Action Waiver is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and will survive termination of these Website Terms of Use.
To initiate arbitration, the party seeking to pursue a legal dispute must prepare a written demand setting forth the claim or claims and deliver the demand within the applicable statute of limitations by hand or first-class mail to the other party.
The arbitration shall be administered by the American Arbitration Association (“AAA”) before a single arbitrator mutually agreed upon by the parties. If the parties cannot agree on an arbitrator within thirty (30) days after names of potential arbitrators have been proposed, the arbitrator will be chosen by the AAA. Except to the extent modified by this section, if you are an individual person, the AAA Consumer Arbitration Rules in effect at the time of filing will apply.
Except as otherwise required by applicable law, you and Vodori agree to arbitrate disputes only on an individual basis and waive any right to bring, participate in, or receive money or other relief from any representative, class, collective, consolidated, or representative proceeding.
No party may bring a claim on behalf of other individuals, and no arbitrator may: (a) combine more than one individual’s claim into a single case without the consent of all parties; (b) order, require, participate in, or facilitate production of class-wide contact information or notification of others of potential claims; or (c) arbitrate any form of class, collective, consolidated, or representative proceeding.
15. Persons Not of Age of Majority
The Website is not intended for use by persons under 18 years of age. Persons who are not at least 18 years of age should not submit information through the Website, and no information in relation to such persons should be submitted through the Website.
16. Waiver and Severability
The failure of Vodori to exercise or enforce any rights or provisions in these Website Terms of Use will not constitute a waiver of such right or provision. If any part or provision of these Website Terms of Use is found to be unenforceable, such part or provision may be modified to make these Website Terms of Use legal and enforceable. The rest of the Website Terms of Use will not be affected.
